Data Protection Statement for Clients
This data protection statement explains how and why Quantum Wealth SA collects and processes your personal data.
1. Scope of Application
In accordance with the requirements of article 19 of the Swiss Federal Act on Data Protection, Quantum Wealth SA, as the Data Controller, informs you that your Personal data, which will be collected exclusively for the purpose of establishing, perfecting and managing your business relationship, will be processed in full compliance with legal obligations and principles, ensuring full protection of your rights.
2. Definitions
In this document, following terms are defined as:
Personal data: any information relating to an identified or identifiable natural person;
Data subject: a natural person whose personal data is processed;
Sensitive personal data:
- data relating to religious, philosophical, political or trade union-related views or activities,
- data relating to health, the private sphere or affiliation to a race or ethnicity
- genetic data,
- biometric data that uniquely identifying a natural person,
- data relating to administrative and criminal proceedings or sanctions,
- data relating to social assistance measures;
Processing: any handling of personal data, irrespective of the means and procedures used, in particular the collection, storage, keeping, use, modification, disclosure, archiving, deletion or destruction of data;
Disclosure: transmitting personal data or making such data accessible;
Profiling: any form of automated processing of personal data consisting in the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements;
Data Controller: means a private person who or federal body which, alone or jointly with others, determines the purpose and the means of processing personal data;
Processor: a private person or federal body that processes personal data on behalf of the Data Controller.
3. How your Personal data are used
The Data subject’s data are collected to enable the Data Controller to provide the service and fulfill contractual obligations, to comply with legal obligations, to respond to enquiries or enforcement actions, to protect its own rights and interests or those of other clients or third parties, and to detect any malicious or fraudulent activities.
The data are processed in order to provide the services offered by Quantum Wealth SA in the context of the execution of contracts with its clients or pre-contractual measures.
In addition, Quantum Wealth SA is subject to legal obligations, regulatory requirements (e.g., under the Federal Banking Act, the Federal Act on Collective Investment Schemes, the Federal Act on Combating Money Laundering and Terrorist Financing in the Financial Sector, the Mortgage Bond Act, FINMA Ordinances and Circulars, as well as Tax laws) and banking authorities (e.g., Swiss National Bank, FINMA) and is obliged to process Personal data in compliance with these obligations.
The purposes of the processing include the assessment of creditworthiness, the verification of identity and age, the prevention of fraud and money laundering and fulfillment of control and information obligations under tax law.
4. Which personal data are processed by Quantum Wealth SA
Quantum Wealth SA processes Personal data obtained from its clients in the context of its business relationship. In addition, Personal data can be obtained from freely accessible public sources (e.g. debt registers, land registers, trade and association registers, press, Internet) or supplied by third-party information providers to support anti-money laundering checks, and they are processed where necessary to provide the contractual services. Customer assessment activities are not carried out in an automated manner but result from analyzes performed by natural persons. Therefore, no processing in the form of profiling is carried out.
5. Disclosure of Personal data abroad
Your Personal data may only be disclosed abroad to recipient Countries for which the Federal Council has determined that the legislation guarantees an adequate level of data protection.
6. Obligation to provide data
Required and only Personal data which are essential for the establishment and maintenance of the business relationship. Without such data, Quantum Wealth SA will generally not be able to perform into or execute a contract for the provision of its services.
The requested Personal data are necessary for the purpose of establishing and maintaining a business relationship and for the fulfilment of related contractual obligations, as well as for the fulfilment of legal obligations.
7. How long data are stored?
Quantum Wealth SA will process and store your Personal data for as long as necessary to comply with its contractual and legal obligations and to safeguard its rights and interests. When these needs cease to exist, your data will be deleted.
8. Who has access to your personal data?
Within Quantum Wealth SA, each organizational unit and external data processor will have access to your data as necessary to fulfil its contractual and legal obligations and to protect its own legitimate interests.
Your personal data may also be disclosed to third parties such as credit institutions acting on your behalf or agencies providing financial, regulatory and reputational risk rating services and to financial sector regulators (e.g. FINMA, Swiss National Bank) or to judicial authorities if required or requested by them, as well as to third parties providing auditing, consulting, legal, accounting or insurance services.
Your personal data will not be disclosed in any other way, unless you have expressly consented to this.
9. What are your data protection rights?
Every Data subject has the right to access his/her data free of charges at any time and, where permitted by law, the right to rectify, erase, restrict processing, object to processing and, where applicable, the right to data portability.
